A company-formation agency can use the Form5472 Prep partner program to connect LLC formation with the client's first federal information filing. The agency starts and monitors each client file, the client signs securely, and Form5472 Prep prepares and submits the package. White-label delivery is available by request for firms that want brand continuity after formation.
The opportunity is not to turn a formation specialist into a tax adviser. It is to create a reliable handoff before the new owner assumes that obtaining an EIN and paying the registered agent completed every federal obligation.
Request a formation-agency partner account to discuss a standard or white-label workflow.
Formation can create the first reportable transaction
The IRS Instructions for Form 5472 apply special reporting rules to foreign-owned US disregarded entities. When the LLC has a reportable transaction with its foreign owner or another related party, it generally files Form 5472 with a pro forma Form 1120.
New LLCs frequently have owner activity before earning revenue:
- the owner pays the state formation fee;
- the owner pays the registered agent or address provider;
- the owner deposits initial capital;
- the owner buys software or services for the LLC personally; or
- the LLC reimburses the owner after its bank account opens.
Those facts are why “the company had no sales” is not enough to conclude that no Form 5472 filing is needed. Formation agents do not have to make the final tax determination, but they are well placed to preserve the dates, payers, receipts, and ownership information that the filing review needs.
A formation-to-filing handoff
| Timing | Formation agency action | Client action | Filing outcome |
|---|---|---|---|
| At formation | Preserve the state-stamped formation date and legal LLC name | Confirm foreign owner details | Establishes the correct entity record |
| EIN stage | Keep the EIN confirmation with the formation file | Verify responsible-party information | Prevents name and EIN mismatch |
| First payments | Record who paid formation, agent, address, and setup costs | Supply receipts and funding details | Builds the first related-party ledger |
| Bank opening | Separate owner deposits, reimbursements, and business receipts | Confirm the purpose of each transfer | Avoids treating every bank movement as revenue |
| Before year-end | Remind the client to preserve owner transactions | Confirm whether ownership or classification changed | Identifies out-of-scope structures early |
| Filing season | Start the client filing from the partner dashboard | Review and sign the prepared package | Creates a documented federal submission trail |
This handoff makes the agency more useful without requiring it to interpret treaty positions, effectively connected income, or state tax nexus.
What the partner dashboard changes
Without a partner system, an agency may send each founder a link and lose visibility. Under the Form5472 Prep partner program, the agency starts one filing per client LLC and sees each file's status under one account.
That status can show whether the filing is still a draft, has been paid, is awaiting signature, has been faxed, or has reached its confirmation stage. The client signs through a secure link; the agency does not need to collect a handwritten signature or share its login.
The dashboard should be treated as the operating view, while the formation agency keeps its own client-management and engagement records.
Standard versus white-label formation bundles
The standard program works when the agency is comfortable introducing Form5472 Prep as the specialist provider. White-label delivery is available by request when the agency wants agreed communications to remain under its own brand.
| Agency model | Recommended delivery | Client experience |
|---|---|---|
| Formation-only service with an external compliance handoff | Standard partner flow | Client knows Form5472 Prep handles the filing workflow |
| Formation plus annual-compliance package | White-label discussion | Agreed communications remain under the agency's brand |
| Adviser-led structure with complex tax work | Partner filing plus separate specialist advice | Routine filing and advisory work stay clearly separated |
| High-volume incorporation platform | Custom partner discussion | Volume, invoicing, communication, and integration needs are scoped first |
White label does not change the underlying taxpayer or government forms. It changes agreed client-facing delivery. Specify which emails, instructions, or other touchpoints require the agency's brand during the application.
A client-ready annual compliance package
A formation agency can present the filing as one defined component of a broader annual calendar:
- state annual report or franchise obligation;
- registered-agent renewal;
- Form 5472 and pro forma Form 1120 review where applicable;
- owner-level or state income-tax review by the appropriate adviser; and
- document retention for the completed year.
Do not bundle those items into one vague promise that “all US taxes are handled.” State exactly which service performs each task. Form5472 Prep covers the supported federal information-return package; it does not automatically include state returns, Form 1040-NR, Form 1120-F, Form 1065, withholding returns, or home-country tax advice.
Records worth transferring at onboarding
For each client LLC, the formation agency should make available:
- state formation certificate and effective date;
- EIN confirmation;
- legal name and principal address;
- owner name, address, country, and foreign tax identifier where applicable;
- invoices and proof showing who paid setup costs;
- initial funding and reimbursement records;
- any ownership changes; and
- the client contact authorized to review and sign.
The first-year Form 5472 guide explains why the formation year deserves its own review even when the company opened late in December.
Apply as a company-formation partner. Include the jurisdictions you serve, approximate annual formation volume, current compliance bundle, and whether white-label communications are required.
Educational and program information only; not tax or legal advice. Service eligibility and white-label scope are confirmed during partner approval.
