To fill out Form W-7 as a nonresident LLC owner, first confirm a genuine individual tax reason: usually a Form 1040-NR filing, a treaty claim, or a documented exception. Then match the reason box, identity details, address, supporting documents, signature, and attached return or exception evidence before submission.
Owning a US LLC does not by itself qualify you for an Individual Taxpayer Identification Number. An ITIN identifies an individual for a federal tax purpose; the LLC uses its EIN. In particular, you do not need an ITIN solely to file Form 5472.
Once a genuine trigger exists, accuracy matters across the whole package. The IRS says to allow 7 weeks for an ITIN status notice, rising to 9–11 weeks during January 15 through April 30 or when applying from overseas, on its ITIN information page. An inconsistent W-7 can turn that wait into a request for evidence or a rejection.

When should a nonresident LLC owner use Form W-7?
Use Form W-7 only when you need a US taxpayer identification number for an individual federal tax purpose and cannot get a Social Security number. A common LLC-owner case is filing Form 1040-NR to report income or claim a refund. Another is a properly documented treaty or withholding exception.
Do not apply just because a bank, formation provider, or generic checklist says every foreign owner needs an ITIN. Form 5472 identifies the LLC with its EIN and can identify the foreign owner with an FTIN and reference ID. Read whether a foreign-owned LLC pays US tax before assuming that company ownership creates an individual return.
The tax reason controls the W-7 package. A return-based applicant normally attaches Form W-7 to the front of the federal return. An applicant who meets one of the IRS exceptions supplies the specific exception evidence instead. A label such as “LLC owner” is not an exception.
Which application type and reason box should you choose?
Choose Apply for a new ITIN if the IRS has never assigned you one, or Renew an existing ITIN if you are reactivating an expired number. Renewal applicants still choose the substantive reason that best explains why the number is needed and complete the prior-number fields.
The W-7 reason boxes cover different applicants. The LLC owner’s usual choices are highlighted by the paperwork, not by the ownership itself.

The exceptions are narrow. Exception 1 covers specified passive income subject to third-party withholding or treaty benefits. Exception 2 covers specified other income. Exception 3 concerns mortgage-interest reporting, Exception 4 concerns dispositions of US real property, and Exception 5 concerns the reporting role under T.D. 9363. Each requires the evidence in the IRS exception table.
What belongs on the name, address, and birth lines?
Enter the individual applicant’s legal details, not the LLC’s. Form W-7 is a personal application even when business income created the need.
Line 1a — legal name. Match the name on the identity evidence and the attached federal return. Separate the first, middle, and family names correctly. A mismatch can delay return processing.
Line 1b — name at birth. Enter the birth-certificate name if it differs from line 1a. Use N/A when it does not apply, following the instructions’ rule not to leave inapplicable sections blank.
Line 2 — mailing address. Use the address where the IRS can send the ITIN notice and, for a mail application, return original documents. A reliable mailing address can differ from the place where you permanently live.
Line 3 — foreign address. Enter the complete non-US address where you permanently or normally reside, even when it repeats line 2. Box b requires a complete foreign address for the current or most recent permanent residence. A treaty applicant’s line 3 country must match the treaty country.
Line 4 — birth information. Enter the date in the form’s month/day/year format and complete the place-of-birth fields from reliable records. Do not convert an ambiguous numeric foreign date by guesswork.
What belongs on lines 6a through 6g?
Lines 6a through 6g connect citizenship, foreign tax records, immigration documents, and any number previously assigned by the IRS.
- Line 6a: Write every country of citizenship in full; do not abbreviate country names.
- Line 6b: Enter the tax identification number issued by your country of tax residence. Use N/A only when none applies.
- Line 6c: Enter only US nonimmigrant visa details—classification, visa number, and expiry. Attach I-20 or I-94 copies when held.
- Line 6d: Identify the first supporting document, issuer, number, expiry, and US entry date. Attach a labelled sheet for additional documents. If you never entered the United States, say so rather than inventing a date.
- Lines 6e and 6f: Answer whether the IRS ever assigned an ITIN or IRSN. A renewal includes the prior ITIN and the name under which it was issued; a legal name change needs supporting evidence.
- Line 6g: Complete the institution and stay details when box f applies, or the requested company details for a temporary US business visit.
Which eight entries create the highest rejection risk?
These eight entries deserve a source-document comparison before signing. The table is a practical risk review, not a substitute for the fillable IRS Form W-7.

Which identity documents should accompany Form W-7?
A valid passport is the only stand-alone document for most adult applicants because it establishes both identity and foreign status. Without a passport, the instructions require at least two accepted document types that together establish both elements, and at least one normally must contain a photograph.
Alternatives include specified national identification, civil birth, visa, driver’s licence, military, voter, state identification, USCIS photo identification, school, or medical records. Eligibility and age limits vary. Documents must be current, and ordinary photocopies are not enough: use originals, copies certified by the issuing agency, or an authorised verification route.
A passport has an extra caveat for certain dependent applicants when it lacks a US date of entry. That dependent rule does not usually affect an adult LLC owner applying for their own return.
Who signs Form W-7 for an adult applicant?
The adult applicant normally signs and dates Form W-7 with an original signature. A spouse cannot sign merely because of the marriage. An adult applicant may have a court-appointed guardian sign, or authorise another individual through Form 2848; the supporting appointment or power-of-attorney document must accompany the W-7.
How do you submit a complete W-7 package?
Submit one internally consistent package through the route that protects your documents and supports the reason selected.
- Confirm eligibility. Establish that the applicant cannot obtain an SSN and has a genuine federal tax need for an ITIN.
- Choose the package type. Attach Form W-7 to the front of the original federal return, or assemble every item required by a specific exception.
- Match the documents. Compare the name, birth details, citizenship, foreign address, and document information across the W-7, return, and evidence.
- Choose document handling. A CAA can inspect permitted original documents and return them immediately. A direct mail applicant sends originals or issuing-agency-certified copies.
- Sign and retain a copy. Keep the exact signed form, return or exception evidence, and document list.
- Mail correctly if filing directly. Use Internal Revenue Service, ITIN Operation, P.O. Box 149342, Austin, TX 78714-9342—not the ordinary Form 1040-NR address.
- Monitor the result. CP565 confirms assignment; a request for more information or rejection needs a response based on the notice itself.

Does owning a US LLC qualify me for an ITIN?
No. LLC ownership alone is not a W-7 reason. You need an individual federal tax purpose, such as filing Form 1040-NR or satisfying a documented exception. Form 5472 alone does not require the foreign owner to obtain an ITIN.
Which W-7 box does a nonresident filing Form 1040-NR choose?
Box b ordinarily fits a nonresident filing Form 1040-NR to report income or claim a refund. The W-7 goes in front of the return, with the taxpayer-number field left blank for the IRS to complete after assignment.
Can an LLC owner use box h without a tax return?
Only when the facts meet a listed exception and the applicant supplies the exact evidence that exception requires. Enter the exception number, subsection where applicable, and category on box h’s dotted line. “LLC owner” is not sufficient.
Is a passport enough for an adult ITIN applicant?

What if my mailing and foreign addresses are the same?

Can someone else sign my Form W-7?
An adult generally signs personally. A court-appointed guardian may sign with appointment papers, or another individual may sign under a properly completed Form 2848. A spouse has no automatic signing authority.
