If your ITIN expired and you need it on a US federal tax return, renew it with Form W-7, current identity and foreign-status documents, and the return or exception evidence required by the current instructions. Do not renew merely for a third-party information return, and do not apply for a different ITIN.
An expired Individual Taxpayer Identification Number is usually a non-use problem, not a cancellation of your tax record. The old number remains the number to renew. The important questions are when it last appeared on a federal tax return and whether an upcoming return genuinely needs it.
The IRS says an ITIN expires on December 31 after the third consecutive tax year in which it was not used on a US federal return, according to its ITIN renewal page. That rule lets you determine status from your own return history without relying on an old middle-digit schedule.

When does an ITIN expire?
An ITIN expires after it has not been included on a US federal tax return for three consecutive tax years. Expiry occurs on December 31 of the third non-use year; the number is expired from the next day.
Focus on the tax year shown on the return, not the calendar year when the return was mailed. If the ITIN appeared on a 2022 Form 1040-NR, the next three tax years are 2023, 2024, and 2025. With no use in any of them, the ITIN expired after December 31, 2025.
An ITIN does not expire merely because the passport used for the original application expired. Renewal still requires current supporting documents, but number expiry follows the federal-return non-use rule.
How can you tell whether your ITIN expired?
Find the most recent federal income tax return on which the ITIN was actually included, then count the next three tax years. The table applies the IRS rule as of September 2026.

The later filing of an older return needs care. The operative question is whether the ITIN was included on a federal return for a tax year within the three-year sequence. When late filings or amended returns make the history unclear, review the IRS account record and the exact return years before treating the table as conclusive.
Do not test validity by submitting a second new application. A renewal identifies the previous ITIN on Form W-7 lines 6e and 6f, including the name under which it was issued.
What happens if you file with an expired ITIN?
Filing with an expired ITIN can delay return processing and restrict certain credits until the number is renewed. The IRS warns that the result may be a reduced refund, penalties, or interest; the exact outcome depends on the return.
The current Form W-7 instructions also state that a return filed with an expired number may be delayed. Renewal should therefore travel with the return when the ITIN is needed, rather than waiting for the IRS to identify the problem after filing.
Expiry does not create a second taxpayer identity. Use the old ITIN in the prior-number section of W-7. The IRS connects the renewal to the existing account rather than assigning a replacement merely because the number was inactive.
How do you renew an expired ITIN?
Renew by building a W-7 package that proves the continuing tax need, present identity, foreign status, and link to the old number.
- Confirm that renewal is necessary. The expired ITIN must be needed on a US federal tax return; information-return-only use does not require renewal yet.
- Check “Renew an existing ITIN.” Do not select the first-time application box.
- Choose the substantive reason. A nonresident filing Form 1040-NR ordinarily selects box b. A treaty or exception applicant selects the reason and supplies the extra entries the instructions require.
- Complete lines 6e and 6f. Check Yes, enter the prior ITIN, and give the name under which the IRS issued it. Attach legal name-change evidence when relevant.
- Assemble the tax package. Current instructions require the renewal W-7 with a US federal tax return unless the applicant qualifies for a listed exception; an exception applicant supplies its required evidence instead.
- Provide current documents. Submit permitted originals, issuing-agency-certified copies, or use a CAA to verify eligible documents.
- Submit through one route. A CAA can submit after document review. A direct-mail package goes to the IRS ITIN Operation address in Austin specified in the instructions.
- Keep the complete record. Retain the signed W-7, return or exception paperwork, document record, and delivery evidence.
A valid passport is the only stand-alone identity and foreign-status document for most adult applicants. Without it, at least two accepted document types must collectively establish both elements, subject to the form’s photograph and eligibility rules.
Do you renew an ITIN without attaching a tax return?
Only an applicant who qualifies for one of the W-7 exceptions submits renewal paperwork without a federal tax return. The current instructions say renewal applications include a federal return unless an exception applies.
The exception is not a convenience election. Exception 1 addresses specified passive income and third-party withholding or treaty facts; Exception 2 addresses specified other income; Exception 3 covers mortgage-interest reporting; Exception 4 covers specified US real-property dispositions; and Exception 5 covers T.D. 9363 reporting. Each has its own evidence list.
An expired number that will not appear on a federal return does not need renewal now. Waiting in that situation is not noncompliance with the ITIN renewal rule.
Can a family renew ITINs together?
Yes, when several expired ITINs are needed on the same federal return, each person completes a separate Form W-7 and the forms travel with that return. Every applicant supplies the identity and foreign-status evidence applicable to that person.
Spouses and dependants do not qualify for renewal simply because the primary taxpayer renews. The IRS requires a spouse or dependant seeking an ITIN for an allowable tax benefit to be listed on the attached return with the applicable schedule, form, or return box. The underlying benefit, age, relationship, residence, and document rules still apply.
Family batching reduces duplicate packaging, but it does not turn one person’s evidence into evidence for everyone. Compare each W-7 with that applicant’s passport or other records and with the spelling used on the return.
When should you not renew an expired ITIN?
Do not renew when the number is used only on information returns that report payments, such as Form 1099, and it will not be placed on a US federal tax return. The IRS explicitly says expired ITINs may continue to be used on information returns.
Do not renew after receiving a Social Security number. Use the SSN and notify the IRS so the records can be combined. Do not seek renewal just to file Form 5472 for a foreign-owned disregarded LLC; Form 5472 generally does not require the owner’s ITIN. An extension request or estimated-tax payment also does not itself justify an ITIN application. The W-7 instructions explain how to mark those items while an ITIN is still to be requested with the later return.
How do four common renewal scenarios work?
Each scenario starts with the last-use year and the next federal tax purpose.
Scenario 1 — Last used on a 2022 return, filing again for 2026. The non-use years were 2023, 2024, and 2025, so the ITIN expired after December 31, 2025. Submit a renewal W-7 with the 2026 federal return and current documents, unless a listed exception controls.
Scenario 2 — Last used on a 2024 return, filing again for 2026. The absence from a 2025 return is only one non-use year. Use the existing ITIN on the 2026 return; the number has not reached three consecutive non-use years.
Scenario 3 — Expired number appears only on payer reports. A platform continues using the ITIN on third-party information returns, but the owner has no federal return requiring it. Renewal is not required yet. Reassess before the next return that would include the number.
Scenario 4 — A taxpayer and dependant both need expired numbers on one return. Prepare a W-7 for each applicant, attach both to the same return, and supply each person’s documents. The dependant must support an allowable tax benefit under the return and documentation rules.
How should you plan renewal around the April filing season?
Submit the complete W-7 with the return by the return’s applicable due date, or handle a valid filing extension separately when the package will not be ready. Do not send a speculative renewal months earlier unless a documented exception permits a return-free application.
Timing is especially important from overseas. The IRS ITIN information page says to allow about 7 weeks, or 9–11 weeks for applications from overseas or during the January 15–April 30 peak period. Those are IRS status-notice estimates, not promised refund dates.
Starting early helps with document review and name discrepancies, but an early incomplete package is not safer than a complete one sent through the correct route. If a passport or national ID is near expiry, obtain current evidence before submission.
