If your name changed after marriage, divorce, or a court order, do not treat that as a first-time ITIN application. First separate the name-record update from the question of whether your existing ITIN needs renewal. If you are renewing and your legal name changed, the IRS requires documentation supporting that change with Form W-7. Source: Form W-7 instructions, name section.

A newly issued passport, by itself, does not tell you which IRS process you need. It may show the same legal name, a changed name, or a different spelling or transliteration. Those are different problems.

Build a chain from the old name to the current name

Keep three sets of information separate: the name previously associated with the ITIN, the current legal name on identity documents, and the evidence explaining the change between them.

For a renewal after a legal name change, the W-7 instructions give examples such as a marriage certificate or court order, which may include a divorce decree. Those records support the change; they do not replace all identity and foreign-status documentation required for the application. Source: Form W-7 instructions.

Illustrative example: an applicant's prior ITIN notice uses a birth surname, while a current passport uses a married surname. The application file should connect the prior assigned name to the current legal name using the relevant legal document. A note saying “new passport” does not explain that connection by itself.

Before submitting, compare:

  • the current legal name, including the order of family and given names;
  • the name and number on the prior ITIN notice;
  • the birth name, where requested;
  • the name on any attached federal tax return; and
  • the dates and names on the marriage, divorce, or court documentation.

If documents conflict, resolve the discrepancy before signing. An adviser should not silently alter the legal spelling to make software accept the application.

Where the names go on a renewal application

The current W-7 instructions explain the legal-name entry on line 1a, the birth-name entry on line 1b when different, and the previously assigned ITIN and name information on lines 6e and 6f. Check renewal eligibility separately

An ITIN application still needs a qualifying federal tax purpose, and an applicant who is eligible for an SSN should not apply for an ITIN instead. Generally, a federal tax return accompanies W-7 unless an applicable exception is met. A name change does not waive those requirements. Does marriage mean I need a second ITIN?

Do not submit a first-time application simply because your name changed. Identify the existing ITIN, check whether renewal is needed, and use the appropriate IRS name-update or renewal process.

The W-7 instructions require documentation supporting a legal name change when renewing. A new passport should not be treated as a reason to omit that evidence.
